Please read these terms carefully. By accessing Doctors Canvas, you agree to be bound by this legal contract between you ("The User") and Doctors Canvas ("The Platform").

1. Eligibility & Certification (Strict BMDC Mandate)

Access to Doctors Canvas is strictly restricted to authorized medical personnel. By registering for or using this Platform, you irrevocably warrant and represent that:

  • You are a qualified medical practitioner holding a valid, active registration with the Bangladesh Medical and Dental Council (BMDC).
  • You possess the legal authority to prescribe medication and treat patients within the jurisdiction of Bangladesh.
  • Your license to practice medicine has not been suspended, revoked, or restricted.

Violation Notice

Usage of this software by quacks, unauthorized personnel, or individuals falsifying their credentials is a violation of the law. Doctors Canvas reserves the right to report such activities to relevant law enforcement agencies and the BMDC immediately.

2. The "AI Assistant" Disclaimer

Doctors Canvas integrates Generative AI ("AI Assistant") to assist in workflow automation. You explicitly acknowledge and agree to the following:

Not a Medical DeviceThe AI features are purely administrative tools for drafting and formatting. They do not constitute a diagnostic medical device.
Probabilistic NatureAI models generate responses based on patterns. They can hallucinate, omit information, or produce factually incorrect suggestions.
Mandatory Human ReviewYou assume full and sole responsibility for verifying every single word, dosage, frequency, and diagnosis generated by the AI before issuing a prescription.

No Reliance: You agree never to rely solely on the AI for clinical decision-making. The Platform disclaims all liability for errors arising from AI suggestions.

3. Professional Liability & Indemnification

The Platform serves as a passive conduit for your medical practice.

Your ResponsibilityYou retain exclusive responsibility for the doctor-patient relationship, patient care, diagnosis, and treatment outcomes. The Platform does not practice medicine.

Indemnification Clause

You agree to defend, indemnify, and hold harmless Doctors Canvas, its developers, founders, employees, and affiliates from all claims arising from:

  • Your use of or inability to use the Service.
  • Medical malpractice claims or patient disputes.
  • Violation of any term of this Agreement or applicable laws.
4. Data Privacy & Controller/Processor Roles

Under applicable data protection laws:

You own the patient data and are responsible for obtaining necessary patient consent for digital record-keeping.

We (Doctors Canvas)Data Processor

We process data solely on your behalf to provide the Service, ensuring confidentiality and integrity.

While we implement industry-standard encryption and security measures, you acknowledge that no internet transmission is 100% secure. You agree that Doctors Canvas shall not be liable for data breaches caused by unauthorized third-party acts, your negligence (e.g., weak passwords), or systems outside our direct control.

5. "As Is" and "As Available" Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Developers expressly disclaim all warranties of any kind, whether express or implied.

  • UptimeWe do not guarantee uninterrupted access. The service may be offline for maintenance or due to technical faults.
  • AccuracyWe do not warrant that the drug database, AI suggestions, or templates are error-free or up-to-date.
You agree to maintain manual backup methods (e.g., paper pads) for prescribing in case of software unavailability.
6. Termination of Service

Doctors Canvas reserves the absolute right to suspend or terminate your account without notice for:

  • Suspicion of fake credentials
  • Violation of these Terms
  • Law enforcement requests
  • Service discontinuation
7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh.
